1. About the service
OverCast is an online pickem and prediction platform where users compete in pools by submitting picks for sports and entertainment events and earning points based on real-world results. The features available to you may change over time and certain features may require a subscription.
No affiliation. OverCast is an independent fan-operated platform. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to World Wrestling Entertainment, Inc. (WWE), All Elite Wrestling (AEW), New Japan Pro-Wrestling (NJPW), Total Nonstop Action (TNA), Major League Wrestling (MLW), Ring of Honor (ROH), or any other professional wrestling promotion or sports league. All event names, talent names, and championship titles referenced in OverCast are the property of their respective owners and are used solely for identification in the context of fan predictions.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create an account or subscribe. By creating an account you represent that you meet this requirement and that the information you provide is accurate and complete.
3. Accounts
You are responsible for your account credentials and for all activity that occurs under your account. Keep your password confidential and notify us immediately if you suspect unauthorized access. We may suspend or terminate accounts that violate these terms or that we reasonably believe are being used in bad faith.
Display names are unique and may be changed subject to a cooldown period. Avatars and other profile content must comply with the acceptable-use rules below.
4. Subscriptions and billing
Some OverCast features require an active paid subscription. Subscriptions renew automatically at the interval selected at checkout (monthly or yearly) until cancelled. You may manage or cancel your subscription at any time from your profile billing page; cancellation takes effect at the end of the current billing period and no proration is provided for partial periods.
Payments are processed by Stripe. OverCast does not store full payment-card details. All amounts are charged in U.S. dollars unless otherwise indicated. Promotional codes and comped subscriptions are non-transferable and may be revoked for misuse.
5. Communications
By creating an account you consent to receive periodic communications from OverCast about events, results, your account, and the service. These may include event recaps, pool activity summaries, billing notices, security alerts, and product updates.
You can opt out of non-essential communications at any time from the notification settings in your profile. Transactional emails (password resets, billing receipts, security notifications) are required to operate the service and cannot be opted out of while you maintain an active account.
6. User content
You retain ownership of the content you submit to OverCast, including your picks, pool memberships, profile information, and chat messages. By submitting content, you grant OverCast a non-exclusive, royalty-free, worldwide license to host, display, and process that content for the purpose of operating the service.
Chat messages are ephemeral by design and are automatically deleted on a schedule documented inside the product. You are solely responsible for the content you submit and for the consequences of submitting it.
7. Acceptable use
You agree not to:
- Use the service to harass, abuse, defame, or harm other users.
- Attempt to gain unauthorized access to other accounts, the service’s infrastructure, or any underlying data.
- Use automated tools, scrapers, or bots to access the service other than tools we explicitly permit.
- Manipulate scoring, leaderboards, or pool standings through shared accounts, sock puppets, or other forms of collusion.
- Upload illegal content, content you do not have the right to share, or content that infringes another party’s intellectual property.
- Use the service for any commercial purpose without our written permission.
Violation of these rules may result in immediate suspension or termination of your account, at our sole discretion.
8. Intellectual property
The OverCast name, logo, page designs, code, and platform features are the property of OverCast and protected by applicable intellectual property laws. These terms do not grant you any right to use OverCast trademarks outside of normal use of the service.
9. Third-party services
OverCast integrates with third-party services including but not limited to Stripe (payments), Supabase (data infrastructure), and Vercel (hosting). Your use of those services is also governed by their respective terms; we are not responsible for outages or changes in their offerings. Predictions on third-party events (wrestling promotions, sports leagues, etc.) are based on publicly available information and we make no representations about the accuracy of any external content referenced inside the product.
10. Disclaimer of warranties
OverCast is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that the service will be error-free, that defects will be corrected, or that the service will be available at any particular time or location.
11. Limitation of liability
To the maximum extent permitted by applicable law, OverCast, its operators, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost data, business interruption, or other intangible losses, arising out of or related to your use of (or inability to use) the service.
Our total cumulative liability to you for any claim arising out of or relating to the service shall not exceed the greater of (a) the amount you paid OverCast in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.
12. Indemnification
You agree to defend, indemnify, and hold harmless OverCast and its operators from any claim, demand, loss, or damages, including reasonable legal fees, arising out of your breach of these terms, your misuse of the service, or your violation of any law or the rights of a third party.
13. Termination
You may close your account at any time from your profile settings. We may suspend or terminate your account if you breach these terms, if we suspect fraud or abuse, or if we are required to do so by law. Upon termination your active subscription is canceled and your right to access the service ends. Provisions of these terms that by their nature should survive termination, including limitation of liability, indemnification, and dispute resolution, will continue to apply.
14. Changes to these terms
We may revise these terms from time to time. When we do, we will update the “Last updated” date above and, for material changes, provide notice through the service or by email. Your continued use of OverCast after a revision takes effect constitutes your acceptance of the revised terms.
15. Governing law and disputes
These terms are governed by the laws of the jurisdiction in which OverCast is operated, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these terms or the service shall be resolved in the courts of competent jurisdiction in that location, and you consent to that venue.
